Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mind Sentry Labs ("we," "our," or "us") governing your access to and use of the Mind Sentry Labs mobile application ("App") and website (mindsentrylabs.com) (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Services under applicable law
• You will use the Services only for lawful purposes

To access certain features of our Services, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit malware, viruses, or other harmful code
• Interfere with or disrupt the Services or servers
• Scrape, data mine, or extract data from our Services
• Use the Services for any commercial purpose without our consent
• Impersonate any person or entity
• Harass, abuse, or harm others

Our Services allow you to submit content, including check-in responses, urge logs, course exercise responses, and AI chat messages ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited license to use, store, and process your content solely for the purpose of providing and improving our Services.

You are responsible for your User Content and represent that:

• You own or have the necessary rights to submit the content
• Your content does not violate the rights of any third party
• Your content complies with these Terms and applicable laws

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and the design and arrangement thereof) are owned by Mind Sentry Labs and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or decompile any software
• Remove any copyright or proprietary notices

Some features of our Services may require a paid subscription. If you purchase a subscription:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage or cancel your subscription through your App Store or Google Play account settings
• Refunds are handled according to the policies of Apple App Store or Google Play Store
• Prices may change with notice; continued use constitutes acceptance

Our Services may contain links to or integrate with third-party websites, services, or content (such as our Skool community, YouTube channel, or social media). These third-party services are not under our control, and we are not responsible for their content, privacy policies, or practices.

Your use of third-party services is at your own risk and subject to the terms and policies of those services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that the Services will meet your requirements or expectations

We do not guarantee any specific results from using our Services. Individual results may vary, and success depends on many factors including your commitment and personal circumstances.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIND SENTRY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Mind Sentry Labs and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Your User Content

You may terminate your account at any time through the App settings by selecting "Delete Account."

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and User Content
• Provisions that by their nature should survive termination will remain in effect

Informal Resolution: Before filing any legal claim, you agree to first contact us at legal@mindsentrylabs.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also provide notice through the App or via email.

Your continued use of the Services after any changes indicates your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mind Sentry Labs regarding the Services and supersede any prior agreements.
